State Law ADU Update for HMB ~ Owner Occupancy No Longer a Requirement

VIDEO. Accessory Dwelling Unit State Law, as of January 1st, 2020, now supercedes the City of Half Moon Bay’s ADU law.

The new ADU state law is considered a “sea change”, with four new ADU categories.

Owner occupancy restrictions are no longer in place. This sunsets in 2025.

This is an advantage for LLC investors, like Black Rock, according to City Council person, Debbie Ruddock, who sees this as dangerous change for the quaint character of Half Moon Bay.

Homeowner Association can no longer disallow ADUs.

The State also changed minimum size and setback requirements.

State has shortened ADU processing requirement from 120 days to 60 days.

I suppose the intent is to increase housing stock, but is anyone else seeing it just providing more VRBO and AirBnB investment returns, and doing nothing for employee housing?

No, because HMB (and in San Mateo County on the Midcoast) doesn’t allow short term rentals in ADUs. HMB did grandfather in about 10 people who were doing short term rentals when they updated their ADU zoning rules in 2018.
